Natural Disaster Policy
Natural Disaster Policies We experienced our first ever Natural Disaster in October of 2004 when we experienced the worst rainfall in the past 100 years in San Jose. The 9:30 pm the night before the race, the park rangers called to tell us that we could not do the event the next morning because the trails were too muddy and they felt runners and mountain bikes would cause permanent damage to the trails. We were left with no option. The next morning we had to tell 1,800 unhappy Muddy Buddy hopefuls that there would be no Muddy Buddy. It was difficult on everyone. Athletes enter a Muddy Buddy to have fun with their friends and family. The course was already set up and all the costs to put on the event, which are substantial, had already been spent.
If an Act of God/terrorism/Community Disaster occurs, what actions are taken? 1. We will make decisions based on safety first 2. Races will be altered as seen fit 3. Athletes in that race will have first right to sign up for that event the next year. 4. Financial: The Muddy Buddy Ride and Run Series cannot accept the risk of a disaster for everyone. Each athlete needs to accept the risk of his or her entry fee. There will be NO REFUNDS or free entries to other future races. The money you paid is spent developing that race.
The Muddy Buddy Ride and Run Series does not save any money if you do not ride and run the course. Muddy Buddy has ordered and paid for every supply and service needed for that race. Muddy Buddy needs to pay for all race supplies or services associated with that race, regardless of the outcome. These include paying for permits, rangers, our staff/offices/warehouse/ administration costs all year..
Registration Policy
1. Non-Refundable Entries: all entry fees are non-refundable and non-transferable to other athletes. If an athlete/team
is unable to attend an event he/she has the following options:
a. Pay a $10 transfer fee before the event he/she is unable to attend. A written request with the $10 fee must be sent to the
MESP office at least one week prior to the race he/she will not be attending.
b. A teammate may be replaced at no charge. Written request must be received with the new and old teammate’s information to
complete the replacement.
2. No concession shall be made after the event has taken place.
3. NSF Checks: In the case of a bounced check, the event will charge a $25.00 fee for all bounced checks. In addition, checks that are returned prior to the event must be redeemed with cash plus the processing fee. Patrons who do not cover NSF checks or who stop payment on checks will not be allowed to race future events.
4. Late fees are determined by the postmark date on the envelope. Late fees must be collected before the entry form can be processed.
5. In the event of a sell-out, all entries received after the closing date will be automatically returned within 5 business days. Waiting lists will not be established for any events.
